- Can a single person constitute a class under Article 14 of the Constitution? Refer to the relevant case laws.
- A minor was sentenced to imprisonment for an offence under an old law which permitted it. Subsequently under the juvenile justice law, minor’s imprisonment was prohibited. Discuss whether such imprisoned minor can avail the benefit of the new law to escape from imprisonment.
- The apex court held in a landmark judgment that the women of all ages professing a particular religion have a right to worship in all temples and can enter the same. A woman professing another faith but denied a similar right under that religion filed a PIL seeking similar right to all the women professing her religion. Decide with reasons.
- A State enacted the Uniform Civil Code to regulate the personal matters of the citizens following different religions. The Law also received the assent of the President. A PIL was filed seeking enactment of the Uniform Civil Code throughout the territory of India by the Parliament. Discuss the maintainability of the PIL.
- A foreigner was arrested for possession of drugs and he was not produced by the police before the magistrate within 24 hours of his arrest. Advise him as to the rights available to him.
- The Supreme Court directed the Central Government to enact a Uniform Civil Code within a period of 6 months. Is such direction binding on the government? Decide.
- The Union of India announced its intention to form a new state without consulting the legislature of the concerned state. Is such an announcement or formation Constitutionally valid? Decide.
- Lands of Tribals living in a small hamlet were acquired by a State Government to establish a thermal power plant. The tribals were not paid any compensation nor were provided with alternate lands. Suggest the remedy to the tribals.
- X, a worker, was terminated from his service without giving reasonable opportunity of hearing. Is X had right to challenge?
- Out of frustration Z, a person attempted to commit suicide. Subsequent to medical diagnosis, he is out of danger. Whether Z is protected under the Constitution of India or not? Decide.
- The State Government detained large number of persons under the Narcotic Drugs Act without trial. The undertrial prisoners questioned the validity on the ground of the violation of Article 21 of the Constitution of India. Decide.
- A person wants to file a writ petition directly in the Supreme Court of India for violations of fundamental rights. Can he do so? Advise him with reference to constitutional remedies for the enforcement of fundamental rights.
- A Devasthanam board appointed a person not belonging to priestly class as poojari in the Hindu Temple. The appointment was challenged by a person belonging to priestly class on the ground that it is against the traditions of religion. Decide.
- A Temple in the public domain restricted the entry of women citing certain ancient scriptures. Is such restriction valid? Discuss.
- Refugees from Sri Lanka came to India in lakhs and want to settle. They filed a writ in the Supreme Court of India that they have right to settle in India. Decide.
- Articles 14, 20, 21 and 22 guaranteed by the Fundamental Rights of Indian Constitution to the citizens of India are suspended by the President of India during the National Emergency. A person wants to challenge in the Supreme Court. Advise.
